Estate Planning

We prepare individually tailored estate planning documents designed to accomplish your goals while minimizing or eliminating any transfer tax consequences.  We take a comprehensive approach to estate planning, investing the time necessary to understand your family dynamics, financial situation, and planning objectives. 

As part of the estate planning process we carefully consider:

• Possible income, gift, estate and generation-skipping transfer tax consequences
• The possibility of future incapacity or disability
• Creditor protection
• Probate avoidance
• Management of family assets

Depending upon your individual needs, we may prepare a combination of the following documents as part of your estate plan:

• Health Care Directives

We also offer representation in connection with advanced estate planning techniques, including advising clients with charitable inclinations on ways to maximize the tax benefits of their contribution, such as through the use of charitable remainder and charitable lead trusts.

Probate Administration - We have extensive experience in the area of probate administration, and have the experience and knowledge required to handle probate matters involving estates of all sizes and complexities, ranging from simple estates requiring a muniment of title to large estates comprised of business interests, real estate or assets located in more than one state. 

Probate Litigation - In the event a dispute arises during the course of the administration of an estate, litigation may be necessary.  We represent clients in disputes involving a trust or estate, and are prepared to prosecute or defend cases involving will contests, allegations of a breach of fiduciary duty, disputes among beneficiaries, and objections to accountings.

Guardianships - In the event a person becomes incapacitated, and does not have estate planning documents in place designating who will manage their financial affairs or make decisions regarding their care, we can assist in obtaining the appointment of a guardian and can advise the guardian regarding his or her fiduciary duties and obligations. 

Asset Protection - We advise clients regarding asset protection and wealth preservation strategies, including family limited partnerships designed to keep family assets in the family, provide for management of family assets, and to transfer family assets on a tax-favorable basis.  We also advise our clients regarding the use of Limited Liability Companies (LLCs), business protection involving the use of corporate entities, multi-generational dynasty trusts, and irrevocable trusts. 

Business Law

At Alcorn Law P.C., we work to ensure that all of your business transactions are concluded properly, with your interests appropriately represented and your rights suitably protected.  We provide complete business representation, including assistance with selecting the appropriate business entity, business formation, and contract and transactional work.

Entity Formation - Selecting the appropriate type of entity for a new business endeavor is an important decision.  Different entities offer varying levels of liability protection and different methods of tax treatment for the business and its owners.  We assist our clients in selecting the right entity to meet their needs and prepare and file all necessary documentation to form the new entity.  We form entities including C Corporations, S Corporations, professional corporations, Limited Partnerships (LP), Limited Liability Companies (LLC), and other entities.

Transactions & Litigation - We negotiate, draft, and review all types of documents, from employment and sales contracts to licenses and other agreements.  Careful contract preparation can protect you from future litigation, but in the event a dispute later arises, Timothy Alcorn is an experienced litigator with the knowledge and advocacy skills to fully represent your interests.  Mr. Alcorn limits the amount of litigation he accepts, in order to ensure that every client receives the best representation.

Family Law
